Only these structures are permitted to be built on agricultural lands - DECREE

“The Decree signed by Mr. President provides a precise classification of temporary structures intended to be built or installed on agricultural lands. The Decree reflects which structures are permitted to be built on agricultural lands. This means that the construction of any structure on agricultural lands that does not comply with the rules stipulated in the Decree, including concrete-based sheds, warehouses, houses and other structures, as reported in some mass media, is prohibited.” This statement was made to the media by Firidun Tagiyev, Head of the Land Use Control Department of the Ministry of Agriculture.

He said that according to the existing rules approved by the Decree, only structures placed on the ground, intended for use in a short time, including during the construction period, constructed of lightweight construction structures and easily assembled and dismantled can be constructed and installed on agricultural lands: “The characteristics of these structures are clearly stated in the Decree. We are talking about structures that are assembled and dismantled without the involvement of special-purpose equipment, that do not have a concrete connection with the ground or are not reinforced concrete, that are installed on separate pillar foundations, and that are constructed of lightweight construction structures. At the same time, the Decree clearly states that temporary structures on agricultural lands are constructed for the temporary storage of agricultural machinery, equipment, grass, feed, medicines (except for the storage of toxic chemicals) and other means, shepherd houses, beds, as well as for the recreation, sanitation and hygiene of employees (personnel) and other purposes. That is, we are talking about permanent residential buildings, stables, warehouses and other buildings, the construction of such buildings on agricultural lands is not allowed according to both the Land Code and the Urban Planning and Construction Code of the Republic of Azerbaijan.

It should be noted that on December 5, 2025, the President of the Republic of Azerbaijan, Mr. Ilham Aliyev, signed a Decree on the rules for informing about temporary buildings intended to be built or installed on agricultural lands. The Decree reflects the characteristics and classification of buildings permitted to be built on agricultural lands. According to the Decree, the construction area of ​​a temporary building should not exceed 300 square meters, its height should not exceed 5 meters, and the length of its spans should not exceed 6 meters. A lightweight structure is a building with a frame made of wood or steel posts and beams with a wall thickness of up to 8 millimeters, as well as walls and partitions made of metal, wood or plastic boards. Such structures can be built for temporary storage of agricultural machinery, hay, feed and other means, shepherd's houses, beds, recreation of workers (staff), sanitation and hygiene and other purposes.

It should be noted that the construction of any structure on agricultural lands outside the rules specified in the Decree is prohibited and such steps entail legal, administrative and criminal liability.
